CHASE THE SUMMER PROMOTION

CONDITIONS

PARTICIPATION

  1. This competition ("Competition") is conducted by Coca-Cola South Pacific Pty Ltd, ABN 50 003 029 794 of 71 Circular Quay East, Sydney NSW 2000 ("Promoter").
  2. Entry to the Competition constitutes acceptance of these conditions. All entry instructions and prize information published by the Promoter form part of these conditions.
  3. The Competition is only open to Eligible Entrants. An "Eligible Entrant" is an individual who: (i) is a resident of Australia aged 13 years or older as at time of entry; and (ii) is not an employee of the Promoter or any of its related corporations or any of their agencies associated with the Competition; and (iii) is not a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of such an employee.
  4. Notwithstanding any other provision of these conditions, a person "Person" is not entitled to enter this Competition if:
    1. the Promoter has formed the opinion that the Person has breached the conditions of entry of a previous contest run by the Promoter; and
    2. the Person has been given written notice by the Promoter stating that, as a result of such opinion of the Promoter, the Person is prohibited from entering competitions conducted by the Promoter (and the prohibition stated in that notice has not been lifted by a subsequent notice to the Person from the Promoter).
  5. Competition entry opens at 00:00 hrs on 2/2/09 and closes at 24:00 hrs on 15/3/09 "Entry Period". All times and dates are times and dates in Sydney which may be AEST or AEDT depending on the date. All times are stated using the 24 hour clock. 00:00 hrs is the start of a day and 24:00 hrs is the end of a day.
  6. To be entitled to any prize, an Eligible Entrant under the age of 18 years must obtain the written consent of their parent or guardian (see condition 39).

ENTRY

  1. To enter, an Eligible Entrant must purchase, from any retail outlet anywhere in Australia, one 600mL bottle of Coca Cola, Coca-Cola Zero, Diet Coke, Diet Coke Caffeine Free, Sprite or Sprite Zero with packaging that refers to this Competition "Promotion Product".
  2. Subject to the other conditions, an Eligible Entrant may enter the Competition once for every Promotion Product that they purchase.
  3. Entry can only be made via the internet. To submit an entry, an Eligible Entrant must use a compatible browser to visit www.sharethesummer.com.au "Competition Website"). The Eligible Entrant must then follow the directions at the Competition Website. If an Eligible Entrant has not previously registered for a Coca-Cola account, he/she will be required to create an account by providing an e-mail address (which will become his/her user name), password, first and last names, postcode, age bracket and a mobile or landline phone number. An entrant must not register more than once. In order to submit an entry, the entrant must use a compatible browser to visit the Competition Website and, in accordance with the directions at the website, provide for each entry: (a) the entrant's user name and password, as established during registration; and (b) the special code under the cap of the Promotion Product being used to enter. An Eligible Entrant must not use more than one account to submit entries on the Competition Website.
  4. All entrants must ensure that their entries are received by the Promoter during the Entry Period. The Promoter takes no responsibility for late or misdirected entries or for any delays or failures in any telecommunications service or equipment.
  5. For each and every Promotion Product an entrant uses to submit an entry, he/she MUST retain the cap from the Promotion Product (which will carry the special code used to enter).
  6. All entries to the Competition may be subject to verification by the Promoter. The Promoter will reimburse an entrant for any reasonable costs incurred in complying with this condition.
    1. An entrant MUST, within 7 days of being asked, deliver to the Promoter (by a means determined by the Promoter) all of the caps which condition 11 requires the entrant to retain and which are requested by the Promoter. The Promoter may elect not to return those items.
    2. An entrant MUST also deliver to the Promoter (by a means determined by the Promoter) copies of any documents the Promoter may request establishing eligibility to enter or win, including evidence of age, residence or identity. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an entrant must deliver requested copies within 7 days of being asked to do so. At the Promoter's request, an entrant MUST also, within 7 days of being asked, allow the Promoter to inspect and copy the original of any such document.
  7. The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant: (i) fails to establish their entitlement to enter the Competition to the Promoter's satisfaction; or (ii) fails to produce items as required by condition 12 or produces items that, in the Promoter's opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or (iii) in the Promoter's opinion, tampers with the entry process or benefits from such tampering; or (iv) in the Promoter's opinion, submits an entry which is not in accordance with these conditions.
  8. An entry by more than one person (ie a joint entry) is invalid.
  9. On any one day an Eligible Entrant may submit no more than 5 entries;
  10. Any costs associated with accessing the Competition Website are the responsibility of the person seeking access and are dependent on the internet service provider used.
  11. Eligible Entrants must make their entries manually using an internet browser. The Promoter may reject entries if it reasonably forms the opinion that they have been entered using automated entry means, by use of a competition entry service, or the Eligible Entrant has used more than one account to enter codes via the Competition Website.

PRIZES

  1. There will be 42 draws (each a "Draw"), one for each day during the Entry Period (each a "Day").
  2. Each entry received during a Day will be allocated to the Draw for the Day during which it was received by the Promoter. An entry received exactly on the start of a Day will be allocated to the Day that is just commencing.
  3. In each Draw, the Eligible Entrant who submitted the first valid entry drawn will win a trip to Los Angeles in the USA for two people ("LA Trip Prize"), valued at a maximum of $11,200 (further details of this prize are set out below).
  4. Entries into one Draw will not be included in any subsequent Draw.
  5. Each Draw will be held at 1/3 Green St, Brookvale NSW 2100. One Draw will be held at 11:00 hrs on the first working day after the Day for which the Draw is held (a "working day" is any day other than a Saturday, Sunday or a public holiday in the place where the draw is held. Accordingly, the first Draw will commence at 11:00 hrs on 3/2/09 and the last Draw at 11:00 hrs on 16/3/09.
  6. The total number of LA Trip Prizes available to be won is 42.
  7. The maximum total value of all prizes is $470,400.
  8. Each prize is valued as at 24/10/08. The Promoter takes no responsibility for any variations in value of a prize.
  9. If a prize (or part of a prize) is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the authorities that have issued permits for the conduct of the Competition. The Promoter accepts no other liability or responsibility for any loss incurred by a winner or any other party if a prize (or part of a prize) is unavailable for any reason.
  10. A right to receive a prize is not transferable or exchangeable and cannot be taken as a monetary payment

LA TRIP PRIZE

  1. Each LA Trip Prize comprises, for its winner and, subject to condition 30, one guest of his/her choice:
    1. return economy flights to Los Angeles (LAX) airport from the Australian State or Territory capital city nearest to the winner's place of residence and return ground transfers between the arrival airport and the Accommodation;
    2. 5 nights’ twin share accommodation at a 4 star hotel in or near Los Angeles, USA ("Accommodation");
    3. A$1,000 or local currency equivalent spending money (in total, to be provided to the prize winner only);
    4. one 90 minute surfing lesson (one lesson for winner and guest together);
    5. two unlimited rides wristbands for Pacific Park Santa Monica Pier (one wristband each for winner and guest);
    6. one day of bike hire with helmet (one day's hire each for winner and guest)
    7. two 3 day Go LA passes (one pass each for winner and guest); and
    8. travel insurance for the winner and their guest for the prize trip with a level of cover to be determined by the Promoter.
  2. Each LA Trip Prize will be arranged by the Promoter. Each winner of a LA Trip Prize must give at least 60 days notice of proposed commencement of travel. All travel must be booked by 31/8/09 and must be completed no later than 15/3/10. Each LA Trip Prize is subject to availability at the time of booking and, if any component of a LA Trip Prize is unavailable on the dates proposed by the winner, the Promoter will consult with the winner to determine alternative dates on which a LA Trip Prize will be booked.
  3. All aspects of the LA Trip Prize (including travel and accommodation) are for the winner and one guest travelling together. Each winner of a LA Trip Prize is free to select any person as a guest, provided that:
    1. the Promoter may require the guest to confirm in writing that they agree to comply with the provisions of these conditions relating to guests (see condition 39);
    2. if a person aged less than 18 years wins a LA Trip Prize, he/she must bring a parent or guardian as his/her accompanying guest.
  4. Once tickets have been arranged by the Promoter, changes to the travel or accommodation arrangements are at the expense of the LA Trip Prize winner. If such changes are made, the winner will incur a $150 change fee per passenger plus all additional costs resulting form any change.
  5. All components of each LA Trip Prize must be taken together as a single trip to be booked by the Promoter. Any part of a LA Trip Prize that is not taken for any reason is forfeited.
  6. Each LA Trip Prize does not (except as expressly stated) include:
    1. any transport between a traveller's residence and the departure airport;
    2. any overnight accommodation while travelling to the departure airport;
    3. any other travel or accommodation;
    4. any meals;
    5. any incidental hotel charges (such as mini-bar charges, telephone calls, in house movies, food and beverages);
    6. any spending money;
    7. any insurance (such as travel or health cover);
    8. any costs associated with any passport, visa, health or other requirements for entry into any foreign country and return to Australia;
    9. any vaccinations or other medical or health related services;
    10. any other ancillary costs which may be incurred by the winner or his/her guest in relation to a LA Trip Prize.
  7. Each LA Trip Prize cannot be exchanged for other travel or accommodation at other destinations.
  8. Each winner of a LA Trip Prize and his/her guest are responsible for compliance with any health, passport, visa and other requirements for entry into USA, any country en-route and return to Australia and bear all risks associated with any refusal of entry into any country. No compensation will be payable if a winner or a guest is unable to use a LA Trip Prize (or any part of it) as stated for whatever reason.

WINNERS

  1. Each winner will be notified in writing sent by e-mail to the e-mail address indicated in the entry. The notification may include instructions as to how the winner is to claim the prize and establish his/her entitlement to it.
  2. The name of each winner of an LA Trip Prize awarded in a Draw held on or before 20/2/09 will be published in The Australian on 27/2/09. The name of each winner of an LA Trip Prize awarded in a Draw held on or after 23/2/09 will be published in The Australian on 23/3/09.
  3. Subject, where relevant, to any directions given under the legislation regulating the Competition, if any prize is not claimed by a winner within 3 months of the prize being awarded, the prize will be awarded to another Eligible Entrant in a redraw commencing at 3pm on 29/6/09 at 1/3 Green Street Brookvale, NSW 2100. If there is a redraw, the name of each winner in the redraw of any of the LA Trip Prizes will be published in The Australian on 13/7/09.
  4. In order to be entitled to any prize, each winner (and, if he/she wins a LA Trip Prize, the person accompanying the winner on the LA Trip Prize) must, if requested by the Promoter, agree to and sign:
      (i) a Statutory Declaration and/or an eligibility form confirming their compliance with the Conditions and eligibility to accept the prize and/or participate in the prize; and (ii) a liability release, waiver and/or indemnity in favour of the Promoter and/or any person or other entity associated with this Competition.
  5. If a winner and/or any guest accompanying them on an LA Trip Prize is under 18 years of age, the winner must ensure that a parent or guardian of the winner (if applicable) and a parent or guardian of any such guest agrees to and signs the documents referred to above on behalf of their child (if requested by the Promoter). A winner will forfeit his/her prize if he/she fails to ensure that all documents relating to that prize (or participation in that prize) are signed in accordance with this condition, as and when required by the Promoter.

GENERAL

  1. If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.
  2. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise).
  3. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
  4. All of the Promoter’s decisions are final and no correspondence will be entered into.
  5. The Promoter accepts no responsibility for any tax liability incurred as a result of an entrant participating in the Competition. Entrants should obtain independent tax and financial advice.
  6. To the full extent permitted by law, the Promoter, its associated companies and agencies and all those entities' personnel (the "Relevant Parties" exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant or any winner's guest on an LA Trip Prize in connection with the Competition or prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death.
  7. Each winner and any guest on an LA Trip Prize consent to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times without remuneration for the purpose of promoting this Competition, the Promoter and/or any of the Promoter's products.
  8. Entrants' personal information and that of any winner's guest on an LA Trip Prize will be collected by or on behalf of the Promoter to enable it to administer the Competition and publicise its winner(s) and, if an entrant consents, may be used to market its products to the entrant. The personal information of each winner and any winner's guest on an LA Trip Prize may be provided to others assisting in the conduct of the Competition, including the Competition administrator, prize suppliers and deliverers, and to regulatory authorities. Persons may contact the Promoter or by visiting www.coca-cola.com.au to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a prize.
